Please read these user terms and conditions carefully before downloading our application or using our services.
Your contracting partner is Treinetic (Pvt) Ltd, a limited liability company having its registered office at No 395/2, 2nd Lane, Ekamuthu Mawatha, Battaramulla, Sri Lanka.
Your access to and use of the GetIn application is subject exclusively to these Terms and Conditions. These Terms and Conditions present the “General Conditions” applicable to the use of services offered by GetIn, either through the website (www.getin.lk) or our mobile application software (the “App”). You agree not to use the App or Website for any purpose that is unlawful or prohibited by these Terms and Conditions. By using the App or Website, you fully accept the terms, conditions, and disclaimers contained in this notice. If you do not accept these Terms and Conditions, you must immediately stop using the GetIn application and website. These Terms expressly supersede prior agreements or arrangements with you.
Supplemental terms may apply to certain services offered by GetIn, such as policies for a particular event, activity, or promotion, and such supplemental terms will be disclosed to you in connection with the applicable services. Supplemental terms are in addition to, and shall be deemed a part of, the Terms for the purposes of the applicable services. Supplemental terms shall prevail over these Terms in the event of a conflict.
Service Information
Information provided through the GetIn platform, including through the website (https://getin.lk), mobile application, ride details, estimated timings, route information, fare estimates, and related content, is provided for general operational purposes only.
Users should not rely solely on platform information when making safety, travel, or ride-sharing decisions. Users are responsible for exercising their own judgment, caution, and discretion when participating in ride-sharing activities arranged through the platform.
Modifications to Website Content and Terms
Treinetic (Pvt) Ltd reserves the right to change, remove, or modify the contents of the website and App at any time without prior notice, and GetIn is not liable to you for any such changes. GetIn also reserves the right to modify these Terms and Conditions. Your continued use of the website, mobile application, or hotline services following any changes shall be deemed your acceptance of the updated Terms.
License
Subject to your compliance with these Terms, GetIn grants you a limited, non-exclusive, non-sublicensable, revocable, non-transferable license to:
- Access and use the App on your personal device solely in connection with your use of the Services; and
- Access and use any content, information, and related materials that may be made available through the Services, solely for your personal, non-commercial use.
Any rights not expressly granted herein are reserved by GetIn and GetIn’s licensors.
User Commitments
By using the GetIn Mobile Application or Website, you agree that:
- You will download the App for your sole, personal use and will not resell it to a third party.
- You will not authorize others to use your account, nor transfer your account to any other person or legal entity.
- You will not use the App for unlawful or fraudulent purposes, including sending or storing any illegal material.
- You will not use the App to cause nuisance, annoyance, or inconvenience to other members of the community.
- You will not impair the proper operation or security of the network, nor attempt to harm the App in any way.
- You will keep your account password and any identification details secure and confidential.
- You will provide us with whatever proof of identity we may reasonably request.
- You will comply with all applicable laws of Sri Lanka while using the GetIn Application.
GetIn reserves the right to immediately terminate your access to the App should you fail to comply with any of the above rules.
Account Verification and Approval
GetIn reserves the right to review, verify, approve, reject, suspend, restrict, or remove any account at its sole discretion for safety, verification, compliance, operational, fraudulent, policy-related, or legal reasons.
Submission of registration information, identity documents, or vehicle details does not guarantee account approval or continued access to the platform.
Fare Estimations and Cost-Sharing
The fare range displayed in the “Fare Estimation” feature of the App is an estimate intended to calculate equitable cost-sharing. The final cost-sharing contribution payable will be calculated and displayed dynamically via the App. The Company takes no responsibility for the accuracy of these estimates or variations caused by route changes. Estimates are exclusive of dynamic route adjustments, which are payable separately as part of the actual ride cost calculation.
Copyright and Intellectual Property
All copyright, trademarks, and other intellectual property rights in the App, Website, and its content (including without limitation the interface design, text, graphics, software, and source codes) are owned by or licensed to Treinetic (Pvt) Ltd or otherwise used by GetIn as permitted by law. You agree to access the content solely for your personal, non-commercial use.
Disclaimers and Limitation of Liability
The GetIn Mobile Application and Website are provided on an “AS IS” and “AS AVAILABLE” basis without any representation, endorsement, or warranty of any kind, whether express or implied, including but not limited to warranties of satisfactory quality, fitness for a particular purpose, security, and accuracy.
GetIn makes no representation or guarantee regarding the reliability, timeliness, quality, suitability, or safety of the services, or that the services will be completely uninterrupted or error-free.
To the maximum extent permitted under Sri Lankan law, GetIn will not be liable for any indirect, incidental, or consequential loss or damage (including without limitation loss of business, data, or profits) arising out of or in connection with the use of our platform.
GetIn operates solely as an intermediary peer-to-peer ride-sharing coordination platform connecting independent Captains and Passengers. GetIn does not provide transportation services, operate as a transport carrier, or employ Captains. Users acknowledge that ride-sharing involves inherent risks and are responsible for exercising personal judgment, caution, and discretion when using the platform. To the maximum extent permitted by law, GetIn shall not be liable for loss, theft, misconduct, delay, injury, accident, dispute, or property damage arising from rides or user interactions arranged through the platform.
Community Conduct
While utilizing the platform, you explicitly agree that:
- You will refrain from any behavior that could damage the reputation of GetIn.
- You will treat all members of the community (Captains and Passengers) with respect and refrain from any unlawful, threatening, harassing, or abusive behavior.
- You will compensate and defend GetIn fully against any claims or legal proceedings brought against us as a result of your breach of these Terms.
Relationship of Parties
GetIn operates purely as an intermediary platform facilitating peer-to-peer ridesharing coordination by connecting independent Captains and Passengers. GetIn does not provide transportation or logistics services, does not function as a transportation carrier, and does not employ the Captains using the platform. By accepting a shared ride, the Passenger acknowledges that GetIn has no direct employment association with the Captain. GetIn is not liable for the acts, omissions, or behavior of any user (including issues related to financial transactions, delays, or code of conduct violations).
Availability and System Integrity
- GetIn does not guarantee continuous, uninterrupted, or error-free operation of the App interface, and shall not be held liable for temporary system downtime.
- GetIn is not liable for errors or inconsistencies stemming from independent third-party systems, such as GPS tracking or mobile data networks.
Indemnification
You agree to indemnify and hold harmless Treinetic (Pvt) Ltd, GetIn, its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, and expenses (including reasonable attorney fees) arising out of your breach of these Terms, your negligence, or your violation of the rights of any third party during a ride.
Booking and Cancellation Conditions
- The User agrees that these Terms apply from the moment the GetIn platform is accessed or used.
- Users may cancel a ride request before the Captain begins traveling toward the pickup location or before the ride officially starts.
- Cancellation fees or other restrictions may apply for late cancellations, repeated cancellations, no-shows, misuse of the platform, or cancellations made after the Captain has committed time, fuel, or travel toward the pickup location.
- GetIn reserves the right to review cancellation activity and take appropriate action against abusive, fraudulent, or excessive cancellation behavior.
Term and Termination
This agreement remains active for an indefinite period. You may terminate your contract with GetIn at any time by permanently deleting the App from your smartphone. GetIn is entitled to terminate this contract and disable your account immediately and without prior notice if you violate any term of these conditions or misuse the service.
Governing Law and Arbitration
These Terms shall be exclusively governed by and construed in accordance with the laws of Sri Lanka. In the event of a dispute, conflict, or claim arising out of or in connection with these Services or Terms, the parties will use their best efforts to resolve the issue amicably. A party must first file a written complaint to the other party to initiate an amicable resolution. Any dispute which cannot be settled within thirty (30) days of the written notice shall be referred to and finally resolved by arbitration in accordance with the Arbitration Act of Sri Lanka.
Ride-Sharing on Behalf of Third Parties
If you arrange or book a shared ride on behalf of another individual through your App account, you assume full responsibility for the accuracy of the trip details and the behavior of the passenger. You remain legally responsible for settling all shared cost contributions associated with that journey. Users are advised to use personal prudence when coordinating trips.
App Rules
- Violation of these Terms may result in temporary suspension, access restriction, or permanent deletion of your GetIn account, with or without prior notice, depending on the nature and severity of the violation.
- Captains retain sole discretion regarding the transportation of pets or animals inside their personal vehicles.
